4.11 Management Practice
The section on management practice addresses the review of the existing management structures in the company. To comply with social and environmental standards in a company in a sustainable manner, it is necessary to create at least basic management structures.
This includes
? The allocation of responsibilities
Responsible managers both in top management and on the operational level should be assigned for all subjects related to social and environmental standards. These include e.g. personnel questions, legal demands, worker safety, industrial engineering and production planning.
? The training and sensitisation of the employees
The vendor is obliged to train the employees regularly and to inform them of their rights. The Tchibo SCoC is also to be visibly posted in the local language inside the factory.
? Internal communication
This comprises regular talks with employees and workers’ representatives, complaint procedures, etc.
? Updating the legal basis
The vendor must be informed about the current state of the national laws at all times, since many regulations are subject to constant changes e.g. with regard to minimum wages. A process should be developed where it is clear who, where and how often the appropriate information is obtained.
? The documentation
In the audit, the vendor has to present the appropriate documents to prove compliance with the social and environmental standards. Only demonstrable evidence can be assessed as such by the auditor. An overview of the documents checked in an auditis located in the appendix 7.2 .
? The lawfulness of the facility
The review during the audit also includes legal documents such as operating licences and building licences. Legal obligations and requirements regarding employees may also not be circumvented, e.g. by using contract assignments or false apprenticeship schemes.
4.11 管理措施
管理措施這一部分強(qiáng)調(diào)對(duì)公司現(xiàn)有的管理結(jié)構(gòu)進(jìn)行審查。為了使公司持續(xù)的符合社會(huì)與環(huán)境標(biāo)準(zhǔn),創(chuàng)建基本的管理結(jié)構(gòu)是非常有必要的。
這包括:
1)責(zé)任的分配
無(wú)論是高層管理人員還是業(yè)務(wù)級(jí)別的主管負(fù)責(zé)人,對(duì)涉及到社會(huì)與環(huán)境標(biāo)準(zhǔn)的所有事項(xiàng)都負(fù)有責(zé)任。例如包括人事檔案問(wèn)題、法規(guī)要求、工人安全、和產(chǎn)業(yè)工程學(xué)生產(chǎn)規(guī)劃。
2)員工的培訓(xùn)及培養(yǎng)其敏感性
供應(yīng)商有義務(wù)對(duì)員工定期進(jìn)行培訓(xùn),并告知其擁有的權(quán)利。智寶的SCoC應(yīng)譯成當(dāng)?shù)卣Z(yǔ)言并張貼在工廠內(nèi)的明顯位置。
3)內(nèi)部溝通
這包括定期的與員工和工人代表溝通,建立投訴程序等。
4)更新法律基礎(chǔ)
供應(yīng)商必須始終關(guān)注最新的國(guó)家法律,因?yàn)樵S多法律法規(guī)時(shí)常更新,例如關(guān)于最低工資的法規(guī)。應(yīng)建立程序,記錄獲取適當(dāng)相關(guān)(法規(guī))信息的人員、地址以及獲取此類信息的頻率。
5)文件
在文件中,供應(yīng)商必須呈現(xiàn)出適當(dāng)?shù)奈募宰C明其符合社會(huì)與環(huán)境標(biāo)準(zhǔn)。審核員只接受能進(jìn)行評(píng)估的可被證明的證據(jù)。請(qǐng)參見(jiàn)7.2章節(jié)——審查文件清單。
6)工廠的合規(guī)性
在審核過(guò)程中,也會(huì)檢查包括經(jīng)營(yíng)執(zhí)照和建筑許可之類的法律文件。對(duì)涉及到員工的法律義務(wù)和要求不能通過(guò)使用承包分配或虛假的見(jiàn)習(xí)方案等類似情況進(jìn)行規(guī)避。
